Hawks take decision to resuscitate Mbombela stadium case

The Hawks plan to resuscitate fraud cases against Kaizer Chiefs manager Bobby Motaung, according to reports.

The Sunday World reported over the weekend that the Hawks are considering reviving the case of fraud against him and his business partners, Herbert Theledi and Marius Grib.

Motaung was arrested on 15 August 2012 alongside the two after they allegedly submitted fake documents in their company Lefika’s bid to design the R1.5 billion Mbombela stadium.

Sunday World reported a meeting was held at the offices of Hawks boss Brigadier Zama Basi in Tshwane on 20 June 2018 where the decision to resuscitate the case was taken.

Investigating officer Warrant Officer Mashudu Mashamba was one of those who attended the meeting, the national weekly tabloid reported.

Also Advocate Patrick Nkuna, the man who guided the police in their investigation and also led the prosecution, was part of the meeting in Basi’s office.

Two senior police sources told the paper that a decision to revive the cases was unanimously taken at that meeting.

“In that meeting Mashamba was ordered to assist to put the case together and to find out [whether] evidential material in the docket were still available. The evidential material included the witness statements and all the tender documents,” said the source.

The source said the witnesses statements and tender documents in the case against Motaung, Theledi and Grib were missing and destroyed, allegedly by corrupt cops.

“Most of the evidential material in the docket have been cut to shreds by corrupt cops who wanted to make sure the case does not see the light of day. But we have a back up,” the source said.

Motaung’s lawyer Zola Majavu said they are not aware the case is being resuscitated.

“My client is unaware of the decision and thus we are not in a position to comment,” he said.

He said should they be made aware of any decision to re-open the case they will definitely defend.

“For the record, our client respects the rule of law and not unsubstantiated gossip, especially if such decisions are communicated to the media before affected parties,” said Majavu.

Both Grib and Theledi said they are also unaware the case is being revived.

The three allegedly submitted a forged tax clearance certificate. The tax clearance submitted was “purported to have been issued by the South African Revenue Service to the Mbombela local municipality as part of the requirements to tender the municipality”, documents read.

Hawks spokesman Brigadier Hangwani Mulaudzi said he will only comment once Basi has returned from leave as he was unreachable.
